MOTION FOR COMPLIANCE AND REQUEST FOR SANCTIONS AGAINST BRUGGGER CORPORATION BY AMIDI CONVENTION WAY, LLC TENTATIVE RULING:

Defendant and Cross-Complainant Amidi Convention Way, LLC’s unopposed Motion to Compel Compliance, which pertains to Amidi’s first set of requests for production of documents (RFPs) to Plaintiff/Cross-Defendant Brugger Corporation, is GRANTED. Code Civ. Proc. Sect. 2031.320. Within 10 days of this Order, Plaintiff Brugger Corp. shall produce to Amidi all unprivileged documents in Brugger’s possession, custody or control responsive to Amidi’s first set of RFPs that Brugger has not already produced.

Amidi’s unopposed request for sanctions against Brugger Corporation is GRANTED-IN-PART in the amount of $800. Code Civ. Proc. Sect. 2031.320(b). Plaintiff represented multiple times in meet and confer correspondence that Plaintiff would produce additional responsive documents to Amidi but never did. Plaintiff also ignored Amidi’s further efforts to meet and confer on this issue and has not opposed this motion. Within 10 days of this Order, Brugger shall pay sanctions to Amidi in the amount of $800, based on two hours of attorney time at $400/hr.
