[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTIONS TO COMPEL

Defendant, State of California propounded special interrogatories, form interrogatories, RFAs, and RPDs on Plaintiff on 11/20/17. To date, despite an extension of time to respond and an additional meet and confer effort, Plaintiff has not served responses. Defendant therefore seeks an order compelling Plaintiff to respond, without objections, to the outstanding interrogatories and RPDs, deeming the RFAs admitted, and imposing sanctions.

Defendant’s motions to compel are granted. Plaintiff is ordered to serve verified responses to form interrogatories, special interrogatories and RPDs, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Defendant’s motion to deem RFAs admitted is also granted. CCP §2033.280(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c), 2033.280(c). Defendant seeks sanctions in the amount of $1000 in connection with the motions to compel responses to interrogatories and RPDs. Notably, Defendant appears to also seek sanctions in connection with the motion to deem RFAs admitted, but the notice of motion is silent concerning sanctions, in violation of CCP §2023.040; the Court is therefore awarding sanctions only in connection with the motions to compel responses to interrogatories and RPDs, and not in connection with the motion to deem RFAs admitted.

Defendant seeks to recover two hours of time to prepare the moving papers, two hours to review the opposition and file a reply, and one hour to appear at the hearing, all at $200/hour. The Court awards one hour of attorney time to prepare each of these form motions to compel. No opposition was filed and therefore no reply was necessary. The Court awards the requested one hour to appear at the hearing. The Court therefore awards a total of three hours (one to prepare the motion to compel responses to form interrogatories, one to prepare the motion to compel responses to RPDs, and one to appear at the hearing) of attorney time at the rate of $200/hour.

Sanctions are sought and imposed against Plaintiff and his attorney of record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through its attorney of record, in the total amount of $600, within twenty days.

Defendant is ordered to give notice.
