Defendant propounded form interrogatories, special interrogatories, and RPDs on Plaintiff on 10/26/17. To date, despite multiple attempts to meet and confer, Plaintiff has not served responses. Defendant therefore moves to compel Plaintiff to provide verified responses, without objection, to the discovery at issue, and to pay sanctions.
The motions to compel are granted. Plaintiff is ordered to serve verified responses to form interrogatories, special interrogatories, and RPDs, without objections, within fifteen days. CCP §§2030.290(a),(b), 2031.300(a),(b).
Sanctions are mandatory. §§2030.290(c), 2031.300(c). Defendant seeks sanctions in the amount of $3060/motion – six hours to prepare each motion and six hours to prepare a reply and appear at the hearing, all at $250/hour, plus filing fees. The Court awards one hour per motion for preparation of these form motions to compel. No opposition was filed and therefore no reply was necessary. The Court notes that Counsel is located in downtown Los Angeles, and therefore awards one hour to appear at the hearing; the time is only awarded once. The Court therefore awards a total of four hours of attorney time at the requested rate of $250/hour, or $1000 in attorneys’ fees. The Court also awards three filing fees of $60 each.
Sanctions are sought and imposed against Plaintiff and her attorney of record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through its attorney of record, in the total amount of $1180, within twenty days.
Defendant is ordered to give notice.
