Defendants Mayra Moran and Eric Polanco’s Motions to Compel Responses to Demand for Production of Documents and Form Interrogatories and to Request for Sanctions are GRANTED.
On January 25, 2018, Defendants Mayra Moran and Eric Polanco (collectively, “Defendants”) served their Demand for Production of Documents and Form Interrogatories on Plaintiff Abalid Aburto (“Plaintiff”). (Farazian Decls. ¶ 3, Exhs. As.) To date, Defendants have not received any verified responses to the propounded discovery requests from Plaintiff. (Id. ¶ 5.)
On July 6, 2018, Defendants filed Motions to Compel Responses to Demand for Production of Documents and Form Interrogatories and to Request for Sanctions (collectively, the “Motions”).
Discussion
Because Plaintiff has failed to respond to Defendants’ discovery requests, the unopposed Motions are GRANTED. Pursuant to CCP §§ 2030.290 and 2031.300, Plaintiff is ordered to serve verified responses, without objections, to Defendants’ Demand for Production of Documents and Form Interrogatories within twenty (20) days from the date of Defendants serving a notice of this Order.
Defendants request $560 in monetary sanctions against Plaintiff and his attorney for each of the Motions. (Notices of Motions pp. 1-2.) Because the Motions have been granted, monetary sanctions are mandatory under CCP §§ 2030.290(c) and 2031.300(c). Given the simplicity of the Motions, the Court finds that one (1) hour to prepare each of the Motions and one (1) hour to appear for the hearing of all the Motions, at a reasonable rate of $250 per hour, along with $120 in filing fees, to be reasonable and sufficient to compensate Defendants. The Court, therefore, awards Defendants $870 in monetary sanctions against Plaintiff and his attorney of record Michael V. Jehdian, jointly and severally. Sanctions are to be paid within thirty (30) days from the date of Defendants serving a notice of this Order.
