The court will deem the requests admitted unless before the hearing on the motion, Plaintiff serves a proposed response to the requests that is in substantial compliance with Section 2033.220. Cal Code Civ. Procedure § 2033.280(b).

The court imposes total sanctions of $800.00 for all four motions against Plaintiff and counsel, whose failure to serve a timely response to Requests for Admission necessitated this motion under §2033.280 (c) and for the failure to provide verified responses to authorized methods of discovery, which constitutes discovery abuse. Cal Code Civ. Procedure § 2023.010(a)(4). Sanctions are payable within thirty (30) days.

Motion by Defendant, Darrell Gibbs, to Consolidate Related Actions,

BC646787 and BC699168, filed on 8/10/18, is GRANTED. The Court finds that consolidation is warranted as the related matters both arise from the same accident and involve common questions of law and fact. Consolidation is necessary to avoid unnecessary costs or delay. Cal Code Civ. Procedure § 1048.
