MOTION TO COMPEL TENTATIVE RULING:
Plaintiff Vince Nakayama’s unopposed Motion to Compel Defendants Suneet Singal and First Capital Real Estate Investments, LLC to provide responses to Nakayama’s First Set of Form Interrogatories, Special Interrogatories, and Requests for Production of Documents, and to Deem Admitted the Requests in Nakayama’s First Set of Requests for Admissions, and for sanctions, is GRANTED-IN-PART, as follows:
The motion to compel responses to Nakayama’s Form Interrogatories, Special Interrogatories, and Requests for Production of Documents is GRANTED. All objections are waived. Defendants Suneet Singal and First Capital Real Estate Investments, LLC shall serve responses, without objections, by Sept. 20, 2018.
The motion to deem Requests for Admission (RFAs) admitted is GRANTED. Each RFA in Nakayama’s First Set of RFAs to Defendants Suneet Singal and First Capital Real Estate Investments, LLC is deemed admitted.
Plaintiff Nakayama’s request for sanctions against Defendants Singal and First Capital Real Estate Investments, LLC, jointly and severally, is GRANTED-IN-PART, in the amount of $1,500, based on four hours of attorney time at $375/hour. The sanctions shall be paid to Plaintiff Nakayama within 20 days of this Order.
If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.
