MOTION FOR PROTECTIVE ORDER TENTATIVE RULING:
The hearing of this matter is continued to October 9, 2018, at 9:00 a. m., in the Law and Motion Department.
The motion offers no evidence by which the Court can determine that the questioning and answers at Plaintiff’s deposition revealed any matter that could be considered confidential or private. Rather than deny the motion for that basic omission, the Court orders as follows:
1. No later than September 26, 2018, Plaintiff shall lodge (not file) with the Court a copy of all portions of the written (not audio or video) deposition transcript that Plaintiff contends contain confidential matter. Plaintiff shall also file and serve, no later than September 26, 2018, a Supplemental Brief that (a) identifies all transcript pages that Plaintiff contends contain confidential information and (b) sets forth in a concise manner the reason or reasons for confidentiality of each page or set of pages. The reasons shall consist only of a simple designation of the basis for confidentiality (e. g., “financial,” “medical,” “personnel matters”), rather than a narrative or argument. The Supplemental Brief shall not exceed five pages.
2. No later than October 1, 2018, any Defendant may file and serve a responsive Supplemental Brief that addresses only the confidentiality designations. Each Defendant’s Supplemental Brief shall not exceed five pages. A Supplemental Brief by any Defendant is optional.
4. Service of all parties’ Supplemental Briefs shall be by personal or electronic means in a manner that guarantees same-day delivery no later than 4:00 p.m.
5. No additional papers shall be filed by any party without leave of court.
Plaintiff shall give written notice of this ruling no later than September 24, 2018.
If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.
