Defendant’s Motion to Compel Production of Unredacted Documents is GRANTED, in part. The court notes that the opposition to the motion exceeds the maximum page limitation of 10 pages under CRC 3.1113 (d). Therefore, pages 11-20 of the memorandum were not considered.

In responding to the document production request, the responding party is obligated to provide those documents which are responsive to the scope of the request. Responding party may not identify responsive documents and then provide redacted copies having made the unilateral determination that certain portions are not relevant. Therefore, plaintiff shall produce unredacted complete copies of all responsive documents, with the exception that documents may be withheld or redacted upon clear identification and itemization of the reason for the redaction based on a specified claim of privilege or confidentiality under a protective order. The documents shall be produced within 15 days of this order.

Monetary sanctions shall be paid by plaintiff to defendants in the amount of $5,000 within 15 days. Defendant’s request for over $38,000 is excessive by both total hours and hourly rate. This order will allow those fees and costs reasonably incurred in the preparation of this motion
