Petitioner’s motion for terminating sanctions striking real party in interest Richard Vandermeeden’s claim opposing forfeiture for his/her failure to comply with this court’s order compelling his/her response to requests for production of documents is UNOPPOSED and is GRANTED.

The earlier discovery order required real party to provide responses to requests for production of documents seeking basic documents relevant to Richard Vandermeeden’s claim opposing forfeiture. Since real party failed to provide the responses to requests for production of documents, this court concludes that terminating sanctions striking real party Richard Vandermeeden’s claim opposing forfeiture will not under the circumstances here constitute a windfall to petitioner. Real party Richard Vandermeeden’s lack of opposition to this motion is also construed as a concession that his/her claim opposing forfeiture lacks merit. Accordingly, the court grants the motion and strikes real party Richard Vandermeeden’s claim opposing

forfeiture.

Having received no objection thereto, the court will sign the proposed order submitted with the moving papers.

This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc. §1019.5; CRC Rule 3.1312.)
