Nature of Proceeding:
Filed By:
Notice of Hearing on Claim of Exemption
Nabavi, Ali

The claim of exemption is GRANTED in part and DENIED in part since it appears the
judgment debtor has understated his/her monthly income, since the Court is not
persuaded that all of the earnings of the judgment debtor are needed for his/her
support and/or the support of family members and since it appears that several of the
claimed monthly expenses are excessive.

The Sheriff is therefore directed to garnish $175 per pay period, not to exceed $350
per month, from the judgment debtor’s earnings and return to the judgment debtor
forthwith all funds withheld in excess of that amount.

The employer may send one payment of $350 per month to avoid unnecessary
administrative expenses. (Code Civ. Proc. §706.025.)
