PLAINTIFF MAXIMO INVESTMENTS’ MOTION TO FOR ORDER COMPELLING COMPLIANCE WITH DEPOSITION SUBPOENA, REQUEST FOR SANCTIONS FOR NON-APPEARANCE AT DEPOSITION TENTATIVE RULING:

The motion to compel is GRANTED. Abraham Farag shall comply with the deposition subpoena within 14 days. The request for sanctions is GRANTED pursuant to CCP §2025.480(j). Abraham Farag shall pay plaintiff $2,318.5 within 30 days. This amount includes $1,662.50 in attorney’s fees incurred to draft the motion plus a $60 filing fee and $596 fee associated with the deponent’s failure to appear. See Deposition of Benjamin Graves, ¶17.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiff shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
