Defendant Roni Lynn Deutch’s motion for stay of civil discovery is UNOPPOSED and
is GRANTED as follows.
Defendant seeks a stay of discovery in the civil action for unfair competition pending
resolution of the criminal contempt matter against her. On August 24, 2010, Plaintiff
filed a complaint against Defendant alleging violations of B&P Code section 17200 and
17500. Plaintiff thereafter obtained a preliminary injunction re: asset freeze and
appointed a Receiver. On April 11, 2011, Plaintiff filed an OSC r: contempt alleging
that Defendant had violated the terms of the preliminary injunction. Plaintiff has now
propounded discovery on Defendant.
Defendant argues that discovery should be stayed because the discovery implicates
Defendant’s right against self incrimination in both the civil action and pending
contempt matter. Plaintiff does not oppose the motion on condition that the order: (1) does not limit
discovery in the contempt portion of the action, (2) allow third-party discovery, and (3)
expressly provides that during the period that the contempt portion of the action is
pending, it was and is impossible to bring the non-contempt portion of the case to trial.
Defendant has not opposed Plaintiff’s request.
Accordingly, the motion is GRANTED in accordance with Plaintiff’s request.
Plaintiff shall submit a formal order pursuant to CRC Rule 3.1312 for the Court’s
signature.
