MARC D. BENDER AND FINKELSTEIN BENDER & FUJII LLP’S MOTION TO BE RELIEVED AS COUNSEL TENTATIVE RULING:

Plaintiff’s counsel’s motion to be relieved as counsel is DENIED. Rule of Professional Conduct 1.16(d) provides that a lawyer shall not terminate a representation until the lawyer has taken reasonable steps to avoid reasonably foreseeable prejudice to the rights of the client such as giving the client sufficient notice to permit the client to retain other counsel. Trial is set to begin on June 17, 2019 and there is no indication that counsel has taken steps to avoid prejudice to Plaintiff that would result from terminating the representation so close to the trial date.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiff shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
