On 2/08/19, Defendant propounded a notice of deposition on Plaintiff, setting the deposition for 3/21/19. Plaintiff did not object, but did not appear. Defendant therefore seeks an order compelling Plaintiff to sit for deposition

The motion to compel is granted. CCP §2025.450(a). Plaintiff is ordered to appear for deposition on 6/30/19 at 10:30 a.m. at the Thomas Law Firm, Inc., 5001 Airport Plaza Drive, Suite 240, Long Beach, CA 90815-1280.

Defendant seeks sanctions against Plaintiff and his attorney of record in the amount of $3625.00. Sanctions are mandatory. §2025.450(c). The Court has reviewed the Declaration of Counsel in support of the motion, and finds the amount excessive. The Court reduces the billing rate for $400/hour to $200/hour. The Court awards one hour to prepare the form motion to compel. No opposition was filed and therefore no reply was necessary. The Court awards three hours to appear at the hearing. The Court therefore awards a total of $800 in sanctions.

Sanctions are sought and awarded against Plaintiff and his attorney of record, jointly and severally; they are ordered to pay sanctions to Defendant, by and through its attorney of record, in the total amount of $800, within twenty days.

Defendant is ordered to give notice.
