DAVID A. BUTLER BRYAN T. BJORGE
DAVID BUTLER, JR’S MOTION TO BE RELIEVED AS COUNSEL TENTATIVE RULING:
The motion is DENIED without prejudice. Rule of Professional Conduct 1.16(d) provides that a lawyer shall not terminate representation until the lawyer has taken reasonable steps to avoid reasonably foreseeable prejudice to the rights of the client such as giving the client sufficient notice to permit the client to retain other counsel. Trial is set to begin on December 16, 2019 and there is no indication that counsel has taken steps to avoid prejudice to defendant that would result from terminating the representation so close to the trial date
