Plaintiff’s Two (2) Motions to Compel Answers to Form Interrogatories, Special Interrogatories, and Request for Production of Documents Propounded on Defendant, Gregory Phillip Ogletree, and Request for Production of Documents; Request for Sanctions are GRANTED. Defendant Gregory Philip Ogletree is ordered to provide verified responses without objection to these discovery requests within ten (10) days. Cal Code Civil Procedure § 2030.290(b) and 2031.300(b).
Plaintiff’s Motion to Deem Matters Admitted Due to Defendant, Gregory Phillip Ogletree’s, Failure to Serve Timely Responses to Plaintiff’s Requests for Admission; Request for Sanctions, is GRANTED. The Requests for Admission served on Defendant Gregory Philip Ogletree, on 4/3/19, are deemed admitted.
The court continued the hearing on 8/5/19 to allow Defendant Ogletree and Plaintiff to meet and confer with respect to sanctions. The parties have not submitted anything further on the issues of sanctions.
Imposition of sanctions against Defendant, Gregory Philip Ogletree, and his counsel of record, Charles Pearce, is warranted for his failure to timely respond to authorized methods of discovery, which is discovery abuse. Cal Code Civil Procedure § 2023.010(d).
Accordingly, the court impose total sanctions of $470 for all three motions against Defendant, Gregory Philip Ogletree, and his counsel of record, Charles Pearce, Esq. Such sanctions are payable within thirty (30) days.
