[TENTATIVE] order RE:

motions to compel discovery responses

Defendant William Sipes (“Defendant”) moves to compel responses from Plaintiff Amity Janow (“Plaintiff”) to: Special Interrogatories, Set One (“SROG”), and Requests for Production of Documents, Set One (“RPD”). Defendant served the SROG and RPD on Plaintiff by mail on May 14, 2019. Plaintiff’s responses were thus due by June 18, 2019. As of the filing date of these motions, Plaintiff has not served responses. Plaintiff does not oppose the motion, and there is nothing in the record to suggest that Plaintiff has complied with her discovery obligations. Accordingly, the motions to compel responses to the SROG and RPD are granted per Code of Civil Procedure sections 2030.290 and 2031.300. Plaintiff is ordered to serve responses to Defendant’s SROG and RPD, without objections, within thirty (30) days of service of this order.

Defendant seeks sanctions in connection with the motions. The Court finds Plaintiff’s failure to respond to Defendant’s discovery a misuse of the discovery process. The Court orders sanctions against Plaintiff and his attorney of record, Michael L. Kahn, jointly and severally, in the amount of $720, which represents four hours of attorney time at a rate of $150 per hour, plus two filing fees of $60 each.

CONCLUSION AND ORDER

Defendant’s motions to compel responses to the SROG and RPD are granted per Code of Civil Procedure sections 2030.290 and 2031.300. Plaintiff is ordered to serve verified responses, without objections, within thirty (30) days of notice of this order. Plaintiff and her attorney of record, Michael L. Kahn, jointly and severally, are ordered to pay monetary sanctions in the amount of $720 to Defendant, by and through counsel, within thirty (30) days of notice of this order. Defendant shall provide notice and file proof of such with the Court.
