Plaintiff, Tomas Kosco filed this action against Defendant, Ryan Patrick Winkler for damages arising out of an automobile accident. Plaintiff has been meeting and conferring concerning the scheduling of Defendant’s deposition since October of 2018. Most of the attempts to meet and confer have been met with no substantive response from Defendant.
At this time, Plaintiff moves to compel Defendant’s deposition. Defendant opposes the motion, contending the parties have agreed to schedule the deposition for 10/21/19 and the motion was not necessary. The Court has reviewed the meet and confer correspondence, attached to the moving papers, and finds Defendant did not participate in good faith in the meet and confer process. The Court therefore finds an order compelling the deposition is appropriate, and also finds imposition of sanctions is appropriate. CCP §2025.450(a), (g).
Defendant is ordered to appear for deposition on 10/21/19 at 11:00 a.m. (or any other time agreed upon by Counsel) at the offices of West Coast Trial Lawyers, 350 S. Grand Ave, Suite 3350, LA, CA 90071.
Defendant and his attorney of record, jointly and severally, are ordered to pay sanctions to Plaintiff, by and through his attorney of record, in the total amount of $860 (four hours of attorney time at the reasonable rate of $200/hour).
Plaintiff is ordered to give notice.
