Analysis:
The case was filed. On June 11, 2019, this Court granted the Motion brought on the grounds that one of the Plaintiffs in the entitled action, Steve Globerman, passed away on April 1, 2019, in Santa Barbara, California, subsequent to the filing of this lawsuit. Plaintiffs’ counsel substituted Sandra Lee Globerman as successor trustee and sole beneficiary of the Globerman Family Trust Dated February 25, 2016, in place of decedent, Plaintiff Steve Globerman. Sandra Lee Globerman was the proper party to be substituted given that she was both the sole trustee of Globerman Family Trust Dated February 25, 2016 and the sole beneficiary of the Globerman Family Trust Dated February 25, 2016.
The case was last on calendar on 11/26/19 and the attorney for plaintiff appeared and reported that a request for Statement of Damages was just filed and asked for a continuance to made sure all paperwork had been filed; the matter was continued to 12/17/19; the proposed judgment was filed 11/22; additionally (1) a request for Court Judgment was filed; (2) a request for partial dismissal was filed [dismissed Does 1 to 20]; (3) a Declaration of Plaintiff Globerman and (4) Dean __ were all filed on 11/22/19; (5) the Statement of Damages for $500,000was filed on 11/26/19.
The Court considered Plaintiffs’ written declaration pursuant to Code of Civil Procedure Section 585(d).
Judgment should be ordered as follows:
1. Against each of the Defendants, Karen Daniels and Pellett Insurance Services, Inc., jointly and severally, in the sum of $347,695.00 for Plaintiff Sandra Lee Globerman, successor trustee and sole beneficiary of the Gioberman Family Trust d/t/d February 25, 2016 for decedent Bruce Globerman;
2. Against each of the Defendants, Karen Daniels and Pellett Insurance Services, jointly and severally, in the sum of $206,800.00 for Plaintiff, Bruce Globerman;
3. Against each of the Defendants, Karen Daniels and Pellett Insurance Services, Inc., jointly and severally, in the sum of $513,693.00 for Plaintiff, Globerman Insurance Agency, Inc.;
4. For pre-judgment interest at the rate of 10% annually from December 10, 2018 (date of filing complaint) to April 5, 2019 (date of entry of default) with a daily rate of $292.65 X 116 days for a total interest amount in the sum of $33,947.89.
5. For attorneys’ fees and costs as allowed by law, to be awarded after judgment by noticed motion.
