This matter will be heard by the Honorable Judge Socrates Peter Manoukian in Department 19 in the Old Courthouse, 2nd Floor, 161 North First Street, San Jose. On 15 May 2014, the motion of Plaintiff Leadfactors, LLC (“Leadfactors”) for an order permitting Plaintiff to file documents under seal was argued and submitted. Defendant Cisco Systems, Inc. did not file formal opposition to the motion.
This is a trade secret misappropriation case. On 3 April 2014, Defendant Cisco Systems, Inc. (“Cisco”) lodged conditionally under seal its Memorandum of Points and Authorities in Support of Cisco Systems, Inc.’s Motion for Protective Order and supporting Declaration. On 14 April 2014, Leadfactors filed its Opposition to Cisco’s Motion for a Protective Order. Leadfactors now moves to have the documents submitted to be placed under seal. The documents contain information that Leadfactors considers its trade secrets.
Pursuant to Rules of Court, rule 2.550 and 2.551 the Court finds good cause that an overriding interest exists in protecting the information submitted to this Court. Accordingly, Plaintiff’s motion to file documents under seal is GRANTED. The Court is directed to remove the following papers from the public record and file them under seal:
(1) Leadfactors’ Opposition to Defendant Cisco System, Inc.’s Motion for a Protective Order;
(2) Memorandum of Points and Authorities in Support of Cisco Systems, Inc.’s Motion for a Protective Order [C.C.P. § 2019.210];
(3) Exhibit A to Declaration of Alexandra McTague in Support of Defendant Cisco Systems, Inc.’s Motion for a Protective Order; and
(4) Exhibit E to Declaration of Alexandra McTague in Support of Defendant Cisco Systems, Inc.’s Motion for a Protective Order.
