[TENTATIVE] ORDER RE:
DEFENDANT PROVIDENCE HOLY CROSS MEDICAL CENTER’S MOTION FOR TERMINATING SANCTION

Defendant Providence Health System –Southern California, dba Providence Holy Cross Medical Center, brings this motion for terminating sanctions against Plaintiff on the basis that Plaintiff has disobeyed court orders. On April 29, 2014, Defendant’s motion to compel responses to Form Interrogatories and motion to have matters deemed admitted were granted. According to the declaration of Defendant’s counsel, Rory Hernandez, Plaintiff was served with notice of this order and has not complied with it. On June 11, 2014, Defendant’s motion to compel responses to Special Interrogatories and to Request for Identification and Production of Documents was granted. According to the declaration of Hernandez, Plaintiff was served with notice of this order and failed to comply.
Plaintiff has also been served with notice of this current motion and has failed to file any opposition. Based on Plaintiff’s disobedience of court orders, Defendant’s request for terminating sanction is granted. Pursuant to CCP §2023.030 (d)(3), this action is dismissed as to moving defendant Providence Holy Cross Medical Center.
Defendant is ordered to provide notice of this order.
