2. MOTION FOR DETERMINATION OF GOOD FAITH SETTLEMENTS BY DEFENDANT CASA DE CADILLAC

The Notice of Related Case filed July 3, 2014 by Defendant Red Granite Pictures, Inc. and Arthur Kourginian is granted. Limited jurisdiction action 13K 14292, Allstate Ins. Co. as subrogee for Michael Emerson v. Artur Kourginian, et al., is related to BC503379 and is assigned to Dept. 97. On its own motion, the Court now revisits the motion to consolidate the Allstate case with this action. On July 7, 2014, this Court denied the motion without prejudice on the basis that the two actions had yet to be related. Because the actions are now related, the motion to consolidate is granted. Case number 13K 14202 is consolidated with BC 503379. All documents with filings after August 11, 2014, are to be filed with the case BC503379 caption.
Motion by Defendant Casa de Cadillac for determination of good faith settlements is granted. The Court finds that the settlements between Casa de Cadillac and Frese, and between Casa de Cadillac and Allstate, were in good faith pursuant to CCP §877.6. All present or future claims against Casa de Cadillac for equitable comparative contribution or partial comparative indemnity, based on comparative negligence or comparative fault are barred.
Defendant Casa de Cadillac is ordered to provide notice of this order, and to file a Notice of Ruling in 13K 14292.
