The claim of exemption is GRANTED in part and DENIED in part since the Court is not
persuaded that all of the earnings of the judgment debtor are needed for his/her
support and/or the support of family members and since it appears that several of the
claimed monthly expenses are excessive.
The Sheriff is therefore directed to garnish $25 per pay period, not to exceed $100 per
month, from the judgment debtor’s earnings and return to the judgment debtor
forthwith all funds withheld in excess of that amount.
The employer may send one payment of $100 per month to avoid unnecessary
administrative expenses. (Code Civ. Proc. §706.025.)
Judgment creditor’s counsel is admonished because the notice of hearing does not
provide notice of the Court’s tentative ruling system, as required by Local Rule 1.06,
and does not provide the correct address for this Court’s Dept. 54. Judgment
creditor’s counsel is directed to contact the judgment debtor forthwith and advise
him/her of Local Rule 1.06 and the Court’s tentative ruling procedure and the manner
to request a hearing, along with the correct address for Dept. 54. If judgment
creditor’s counsel is unable to contact the judgment debtor prior to hearing,
judgment creditor’s counsel is ordered to appear at the hearing in person or by
telephone.
