THE COURT:

The petition for rehearing filed by defendant Steven Arthur Reynolds is denied.

The opinion herein, filed on June 4, 2009, is modified as follows:

On page 19 of the slip opinion, the citation to People v. Castillo (2009) formerly

at 170 Cal.App.4th 1156, is deleted.

On page 20 of the slip opinion, the reference to People v. Castillo, supra, in the

first full paragraph is deleted. The sentence and citation which follows it should now read:

A proceeding to extend a commitment under the SVPA focuses on the person’s current mental state based upon current mental evaluations. (Bourquez, supra, at p. 1289.)

There is no change in the judgment.
