Ahryah Ward vs. St. Hope Public Schools

Nature of Proceeding: Motion for Order Sealing Record (Defendant Marston)

Filed By: Delanoy, Talia L.

Defendant Marston’s motion to seal is GRANTED.

Marston moves to seal the following records:

· Juvenile Court Order re Confidential Records;

· Notice of Motion and Motion for Summary Judgment or Adjudication and Unredacted Memorandum of Points and Authorities in Support of Motion for Summary Judgment or Adjudication;

· Unredacted Separate Statement of Undisputed Material Facts in Support of Motion for Summary Judgment or Adjudication

· Unredacted Index for Compendium of Exhibits and Exhibit 6 thereto.

The above documents include Plaintiff’s confidential juvenile records and references thereto. The Court finds that Plaintiff’s confidential juvenile records warrant sealing under CRC Rule 2.550 et seq. Good cause to seal exists since the records contain personal, private and sensitive information which warrants protection from public disclosure, the right of public access to this information does not outweigh defendant’s interest in protecting the information, the value of the information being shielded will likely be prejudiced if disclosure is not limited, the proposed limit on access is narrowly tailored to only the private and sensitive information contained in the medical records and there are no less restrictive means to protect the value of the private and sensitive information.

Appropriately redacted versions of the documents have been filed and the unredacted versions were lodged conditionally under seal.

The Clerk is directed to file and seal the documents lodged conditionally under seal.

This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc. § 1019.5; CRC Rule 3.1312.)
