REVIEW HEARING RE: RALLY VISITATION PURSUANT TO STIPULATION AND ORDER FILED 10/27/17

TENTATIVE RULING

The Court has read and considered the pleadings, declarations, and other evidence submitted in this matter. After full consideration of these matters, and for good cause shown, the Court makes the following findings and orders:

1. Petitioner’s request that Respondent go to a 52 week batterer intervention program is DENIED.

2. Respondent’s request for unsupervised visits is DENIED WITHOUT PREJUDICE. The Court is concerned about the allegations of prior alcohol and substance abuse. In addition, the children are additional protected persons under the restraining order issued on 10/27/17. The Court will consider allowing unsupervised visitation after Respondent completes a parenting class, shows proof of participation in AA/NA meetings or other appropriate alcohol/substance abuse treatment, and begins joint counseling with Willow.

3. Respondent’s request to switch his Saturday supervised visit to Sunday is GRANTED.

4. Respondent’s supervised visits with the minor children are increased to every Tuesday from 5:30 p.m. to 6:30 p.m. either at Rally, or by a third party supervisor designated by the same process in the parties’ stipulation filed on 10/27/17.

5. All other orders not in conflict with today’s orders remain in full force and effect.

6. The matter is continued for review of Respondent’s visitation and receipt of Rally report on 5/22/18 at 9:00 a.m. in Department 403.

7. Counsel for Petitioner shall prepare the findings and order after hearing and amended restraining order after hearing if needed.
