Ruling: The Court is getting very little information or help from either side in this case. There is no POS for the contempt matter and that case will go off calendar. The trial of the underlying case is set for February 18, 2020, at 11:30 am; trial briefs due one week in advance; Mr. Morales to give notice.

Background

A lot of courtroom time has been consumed by this case but precious little has actually been accomplished.

On 5/6/19 the Petition for Dissolution was filed by Marcus Morales; lists no minor children and a DOM on 4/2012 with DOS TBD; a RFO was immediately filed and set for hearing on 6/4; it was continued to 7/16; a Response on the Dissolution matter was filed on 7/15 with Elizabeth O’Brien representing Respondent; on 7/16 the matter was “specially set for a hearing 8/5;” the Court filed an extensive ruling after hearing; on 9/16 Elizabeth O’Brien was relieved as counsel at her request; on 9/18 the Court issued a writ of execution requested by Petitioner against Respondent.

On 9/19/19 Petitioner filed an OSC re contempt against Respondent seeking to hold him in contempt for failure to pay spousal support [five alleged Counts]. On 9/26 attorney Marcus Morales filed a FLIS related to the CMC and reported that the underlying case should be continued for 60 days.

The case was on calendar on 10/15/19 when only Mr. Morales, the attorney for Petitioner appeared, and the Court made the following rulings: The CMC is continued to 12/17/19; as for the OSC re Contempt, the file does not reflect that Citee was personally served; that matter cannot go forward on 10/15; it may be rescheduled if requested. The OSC re Contempt was rescheduled and continued to 12/17/19.

The Court’s Conclusions

There is very little being actually accomplished insofar as the Court can determine; the OSC re contempt should go off calendar for failure to file a POS. I should set a trial date and get the case concluded.
