MOTION TO QUASH OR LIMIT SUBPOENA OF PLAINTIFF’S MEDICAL RECORDS AND REQUEST FOR AWARD OF ATTORNEY FEES AGAINST DEFENDANT AND HER ATTORNEYS OF RECORD BY ALISON JAGHAB TENTATIVE RULING:

Plaintiff Alison Jaghab’s Motion to Quash or Limit Defendant Irlanda Fuentes-Perez’s Subpoena of Plaintiff’s Medical Records from Kaiser Permanente is OFF-CALENDAR. On 3-22-18, Defendant filed a Supplemental Opposition to this motion, attaching a court Order from a district court in Travis County, Texas, Case No. D-1-GN-18-001285, captioned The Texas Department of Insurance v. Access Insurance Company. Defendant contends the Texas court order stays this case for a period of 90 days effective 3-13-18. Plaintiff’s counsel has indicated to the Court that although Plaintiff does not necessarily agree that the Texas court order stays this proceeding, Plaintiff does not oppose a 90-day stay of this case. Accordingly, the hearing on this motion is off-calendar, potentially to be reset by Plaintiff following resolution of this issue.

This case is set for a Mandatory Settlement Conference (MSC) on 4-11-18 and for trial on 4-3018. This Order does not affect/vacate the MSC or the trial date. Requests to vacate/continue the MSC and/or trial dates must be directed to the department of the Presiding Judge.
