Plaintiff, Andrea Viglietta-Pichler filed this action against Defendant, Frogurt Empire, Inc. dba Pinkberry for damages arising out of a fall that occurred when a chair collapsed. Plaintiff filed her complaint on 5/04/16, and the matter was originally set for trial on 11/06/17. The parties have stipulated twice to continue the trial date, and trial is currently scheduled for 4/25/18.

At this time, Defendant moves to continue the trial date for three months, from 4/25/18 to 7/25/18. Of note, all parties to the action agree to the requested continuance. Defendant indicates the reason for the requested continuance is the parties’ desire to participate in mediation, which is scheduled for 5/11/18.

The Court finds the parties’ desire to conduct a mediation constitutes “good cause” to grant the motion to continue the trial date, and the motion is granted. The 4/25/18 trial date is advanced to today’s date and continued to Wednesday, 7/25/18 at 8:30 a.m. in D-92. The 4/18/18 FSC is advanced to today’s date and continued to Wednesday, 7/11/18 at 10:00 a.m. in D-92. All discovery cut-off dates are continued to reflect the new trial date.
