The defense motion to compel depositions is substantively UNOPPOSED and GRANTED.
Counsel shall promptly coordinate dates for the depositions, which shall commence no later than 7/06/18 or such other date(s) to which counsel stipulate in writing.
Because the substance of the motion is unopposed, the court will not impose a monetary sanction under CCP § 2025.480(j).
Pursuant to CCP §§ 2023.010(d), (i), 2023.020 and 2023.030(a), however, the court imposes a monetary sanction against Plaintiffs and their counsel, Andrew J. Collins, in the amount of $585 (3 hrs @ reasonable rate of $175/hr + $60 filing fee). Collins repeatedly failed to discuss alternative dates for the depositions, and the failures necessitated the instant motion.
Plaintiffs and Collins shall pay the sanction no later than 7/06/18. If Plaintiffs and Collins fail to pay the sanction by such date, then Defendants may lodge for the court’s signature a formal order awarding sanctions, which may be enforced as a separate judgment. (See Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)
The minute order is effective immediately. No formal order pursuant to CRC 3.1312 or further notice is required.
