Petitioner/Respondent, Mid Century Insurance Co.’s unopposed Motions to Compel Claimant Ray Sanders’ initial responses to Form Interrogatories, Special Interrogatories, and Demand for Production of Documents; and request for sanctions is granted. Claimant to respond without objection within 20 days. Sanctions of $1,200 for all three motions are imposed against Claimant.

Petitioner/Respondent, Mid Century Insurance Company filed this Petition for Case Number in an uninsured motorist arbitration proceeding.

Mid City Insurance (“Mid City”) propounded: (1) Form Interrogatories, (2) Special Interrogatories; and (3) Request for Production of Documents, set one, upon Claimant, Ray Sanders (“Sanders”), by and through his attorney on 5/31/13. Exhibit A. On 7/15/13, Mid City’s counsel wrote to Sander’s counsel requesting responses since none had been received and they were overdue. On 8/16/13, Sander’s counsel requested and was granted an extension to 8/26/13. On 9/11/13, having received no responses, Mid City’s counsel wrote and then on 12/11/13, called Sander’s counsel, who promised that responses would be forthcoming. To date, no responses have been received, and therefore, Mid City requests that the court compel Sander’s responses within 20 days and impose sanctions of $300 per motion against Sanders.
Claimant fails to oppose this motion. Therefore, the initial responses should be compelled.
Mid City Insurance seeks sanctions of $300.00 against Sanders for the hours spent preparing this motion and attending the hearing. The Court finds that sanctions are appropriate based on Sander’s willful failure to abide with discovery obligations. CCP §§ 2030.290(c),2031.300(c). The request for sanctions is therefore granted.
