Defendant County of Sacramento’s motion for terminating sanctions against plaintiff Aleta Guthrey-Narveson for failing to comply with this court’s earlier order compelling plaintiff’s responses to written discovery is UNOPPOSED and is GRANTED IN PART, as follows.

The court declines to impose terminating sanctions here because it will under the circumstances here result in a windfall to the moving party but the court will grant defendant County’s request for an order compelling plaintiff Aleta Guthrey-Narveson to provide verified further responses, without objections, to Special Interrogatory Nos. 2 and 3 no later than 4/16/2018 (unless defendant County agrees to a later date memorialized in writing).

Defendant County is also awarded monetary sanctions in the amount of $185 representing one hour of attorney time. Sanctions to be paid by plaintiff and/or her attorney no later than 4/30/2018 and if not paid by that date, defendant may prepare for the Court’s signature a formal order granting the sanctions, which may then be enforced as a separate judgment against plaintiff and/or her attorney. (Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)

Plaintiff is advised that failure to comply with this ruling may lead to the imposition of additional sanctions, including terminating sanctions.

Moving party to provide notice of this ruling and file proof of service of same no later than 4/12/2018.
