Plaintiff and Cross-Defendant, Bedros Avakian propounded form interrogatories, special interrogatories, RPDs, and RFAs on Defendant and Cross-Complainant, Talia Rene Barr on 11/30/17. Plaintiff granted an extension of time to respond, but Defendant did not serve responses. On 2/28/18, Plaintiff filed these motions to compel responses to form interrogatories, special interrogatories, and RPDs, as well as to deem RFAs admitted.

Plaintiff’s motions to compel are granted. Defendant/Cross-Complainant is ordered to serve verified responses to form interrogatories, special interrogatories and RPDs, without objections, within ten days. CCP §§2030.290(a),(b), 2031.300(a),(b).

Plaintiff’s motion to deem RFAs admitted is granted. CCP §2033.280(b).

Sanctions are mandatory. §§2030.290(c), 2031.300(c), 2033.280(c). Plaintiff seeks sanctions in varying amounts in connection with each motion. Counsel bills at the rate of $350/hour. The Court awards one hour of time to prepare each of these form discovery motions. No opposition was filed and therefore no reply was necessary. The Court awards two hours to appear at the hearing on the motions, but only awards the time once. The Court therefore awards a total of six hours of attorney time at the requested rate $350/hour, or $2100 in attorneys’ fees. The Court also awards four filing fees of $60 each, or $240 in costs. Sanctions are sought against and imposed against Defendant and her attorney of record, jointly and severally; they are ordered to pay sanctions to Plaintiff, by and through his attorney of record, in the amount of $2340, within twenty days.
