Nature of Proceedings: (2) Motions to Compel; Motion for Admissions

Plaintiff served form and special interrogatories, a demand for production, and a request for admissions upon defendant, on November 21, 2018. No responses were ever received to the discovery, in spite of multiple requests. Plaintiff has now moved to compel verified responses, without objection, to the interrogatories and demand for production, and to have the admissions deemed admitted. Plaintiff also seeks a total of $1,755 in sanctions, for being forced to bring the motions.

The Court will grant the motions to compel verified responses, without objection, to the form interrogatories, special interrogatories, and demand for production. Defendant shall provide those responses no later than June 7, 2019. Unless verified responses to the requests for admissions are received by plaintiff at or before the hearing on the motion for deemed admissions, the matters set forth in the request for admissions will be deemed admitted. If such verified responses to the requests for admissions are, in fact, received by plaintiff at or before the hearing on this motion, the motion for deemed admissions will be denied. Whether or not that occurs, the Court will impose the $1,755 in sanctions against defendant, its attorney, or both, payable forthwith.
