On 1/30/18, the Court granted Plaintiff’s motion to deem RFAs propounded on Defendant admitted. The Court’s ruling included the following pertinent language:

Sanctions are sought and imposed against Defendant and his attorney of record, jointly and severally; they are ordered to pay sanctions to Plaintiff, by and through his attorney of record, in the total amount of $1685, within twenty days.

At this time, Defense Counsel seeks an order vacating imposition of sanctions on him personally, and seeks an order that the sanctions by payable by Defendant, as an individual, only. On 2/27/18, the parties submitted a stipulation and proposed order to enforce the sanctions award against Defendant only; the Court has, since that time, signed the proposed order. The motion is therefore taken off calendar as moot at this time.
