RULING

Mandatory sanctions in the amount of $8,126.16 are awarded to Defendant and Cross-
Complainant Newman from Lewis, Brisbois, Bisgaard & Smith, LLP pursuant to Code of
Civil Procedure § 2024.050(c). There was neither substantial justification nor other
circumstances that mitigate against the justice of imposing this sanction. The sanction shall
be paid within thirty (30) days of service of notice of this order.

In the event that no party requests oral argument in accordance with Marin County Superior
Court Local Rules, Rule 1.6 B., the prevailing party shall prepare an order consistent with the
announced ruling as required by Marin County Superior Court Local Rules, Rule 1.7.
