REQUEST FOR ORDER CHILD SUPPORT, SPOUSAL SUPPORT, -PROPERTY CONTROL
TENTATIVE RULING
Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the court makes the following findings and orders:
Mother’s request for exclusive use of the marital home is denied.
Father’s request for child support and temporary spousal support is denied without prejudice, as the marital standard of living/status quo is currently being maintained for the children and the parties under the current cohabitation and financial arrangements.
Mother’s request for sole physical custody of the minors is denied. The court finds it is in the best interests of the minor children for the parents to share physical and legal custody. Further, so long as the parties remain in the same home, the court believes it is premature to set a visitation schedule.
Mother’s request for a vocational evaluation is denied.
The court is concerned about Father’s past abuse of alcohol. The court acknowledges and appreciates that Father has voluntarily signed up for Soberlink. As Father will continue to cohabitate with the minor children, the court will order Father to continue using Soberlink, using the same protocol already in place, i.e., four times a day, beginning at 7:45 a.m. and the final test at 10:00 p.m. Father shall instruct Soberlink to provide real time results of all tests – not just missed or failed tests – to Mother.
Father’s objections to the following statements by Mother in her Request for Order are sustained: FL-300, Attachment 10, at p. 3, lines 6-10, lines 13-14, and lines 16-20. The remaining objections are otherwise overruled.
