REQUEST FOR ORDER TEMPORARY EMERGENCY ORDER, CHILD CUSTODY, -ORDER SHORTENING TIME(GRANTED)

TENTATIVE RULING

The matter is on calendar for review of the status of the child custody evaluation, reallocation of the evaluation’s costs, and possible setting of a Judicial Settlement Conference and long cause hearing. The Court has read and considered the pleadings, declarations, and other evidence submitted in this matter. After full consideration of these matters, and for good cause shown, the Court makes the following findings and orders:

1. Appearances are required.

2. Although the Court hoped to limit the costs of the child custody evaluation, the court-appointed

custody evaluator indicates that “a competently and meaningfully analysis cannot and will not be made” in the absence of a “compare and contrast” in-home assessment. The previous order allocated the evaluator’s fees and expenses equally between the three parties. After consideration of each party’s income and expense declaration, the Court hereby reallocates responsibility for evaluator fees and costs as follows:

a. Jeffrey Hill and Jessica Collins will each pay 12.5% of the evaluator’s total fees and costs.

b. Dianne Collins will pay 75% of the evaluator’s total fees and costs.

3. Counsel for Respondent shall prepare the order.
