Rulings: The Matter is on calendar for Tuesday, February 20,2018, Line 4: PLAINTIFF SUNWOO HWANG’S Motion For Attorney’s Fees And Expenses. Plaintiff Sunwoo Hwang’s motion for attorney’s fees and expenses is granted in large part. Plaintiff is entitled to an award of fees of $28,721 and expenses of $3797.02 for a total award of $32,518.02 against defendants Proferian LLC and James Trout. The applicable statute for fees is Civil Code 1717, not 1717.5 because there is a fees clause in the MIPA. All of the hours spent by plaintiff’s counsel were reasonable. Defendants do not contest any of the costs claimed in the memorandum of costs filed by plaintiff. Plaintiff does not provide a persuasive reason why he should receive a fees award in excess of what he has paid. The court has included $3000 in fees and $90 in expenses for this motion.
