REQUEST FOR ORDER RE DIVISION OF ADVANTIS CREDIT UNION ACCT WITHIN
PETITIONERS CONTROL
TENTATIVE RULING

1. Respondent’s request for division of the Advantis Credit Union Account is denied.

Respondent request for an advance of community property funds from the Advantis Credit Union Account is granted.

Petitioner may receive an advance of community property in the amount of $30,000.

The Court reserves jurisdiction over the characterization and allocation of the advance pending the final property division.

The advance shall be paid within 45 days of the date of this order.

2. Respondent’s request for attorney’s fees pursuant to Fam. Code section 2030 is granted in the amount of $20,000 for past and future attorney’s fees.

The Court bases its decision on the following: Respondent earns gross income of approximately $4,000 per month with total expense of $6,705. (See, Respondent’s Income and Expense Declaration, filed 7/1/19).

Petitioner earns over $20,000 in gross income, and claims $7,656 in monthly living expenses, and $3,000 in monthly travel expenses. (See, Petitioner’s Income and Expense Declaration, filed 6/25/19).

The Court finds that Respondent has demonstrated a need for attorney’s fees and Petitioner has the ability to contribute to Respondent’s attorney’s fees.

An award of attorney’s fees is necessary in this matter to ensure parity in representation.

Petitioner shall pay $10,000 within 30 days of this order and the balance within 60 days of the date of this order.

3. Respondent’s counsel shall prepare the FOAH.
