REQUEST FOR ORDER FOR CHANGE OF VISITATION (PARENTING TIME)
TENTATIVE RULING

Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the court makes the following findings and orders:

This matter is on calendar on Mother’s request to modify the current visitation order.

Mother has presented evidence that the parties’ minor daughter, Torah, attends a live online school Monday through Friday.

Mother also presented evidence that Father does not allow Torah to participate in her online schooling during his custodial Mondays.

In his response, Father does not deny this, and does not provide any explanation for why he refuses to allow daughter to participate in online school.

The court finds that Torah’s education and regular participation in school is extremely important to her development and well being, and that Father’s refusal to allow Torah to participate in school during his parenting time is detrimental to Torah’s best interests.

Based on the evidence presented, the court finds that it is in Torah’s best interests to modify the visitation schedule as requested by Mother.

Commencing on August 1, 2019, Father shall have parenting time with Torah every weekend, from 1:30 PM on Saturday until 7:00 PM on Sunday.

All exchanges shall take place at 850 Bryant Street in San Francisco.

The court denies Father’s request for parenting from Monday through Friday each week, or in the alternative, for a two-week on, two-week off schedule. The court also finds that the parties’ agreement to ten days of vacation for each parent each year is in the child’s best interests, and denies Father’s request for 14 day vacations at this time. Longer vacations may become appropriate once the child is older.
