REQUEST FOR ORDER FOR CHANGE OF CHANGE OF VISITATION (PARENTING TIME),
ORDER FAMILY THERAPY, APPOINT EVIDENCE CODE 730 EXPERT TO CONDUCT FULL
CUSTODY EVALUATION
TENTATIVE RULING

1. Respondent’s request for a long cause hearing is denied.

2. Petitioner’s Request for Order for change in parenting time is denied.

3. Petitioner’s request for order for family therapy is granted. Parties are ordered to meet and confer and exchange the names of therapists no later than August 1, 2019. If the parties are unable to reach an agreement, the parties shall each submit the names of three therapists to the court by letter brief no later than August 6, 2019, and the court will select the therapist. Both parties are ordered to cooperate with the therapist and attend all scheduled therapy sessions. The parties shall equally divide all uninsured expenses for family therapy.

4. Petitioner’s request to appoint a 730 expert to conduct full custody evaluation is granted. Parties are ordered to meet and confer and exchange the names of three custody evaluators no later than August 1, 2019. If the parties are unable to reach an agreement, the parties shall each submit the names of three custody evaluators by letter brief to the court no later than August 6, 2019, and the court will select the custody evaluator. Both parties are ordered to fully cooperate with the custody evaluator. Petitioner shall pay 100% of the cost of the custody evaluator, subject to reallocation. The Court specifically reserves jurisdiction to reallocate the cost of the custody evaluator pending further hearing.

5. Petitioner’s Objections to Respondent’s Responsive Declaration to Request for Order filed on May 16, 2019, are granted as to Exhibits A, B, C, D, E, F and K.

6. Respondent’s Objections to the Declarations of Chris Ruscoe, Steven Green, and Theresa Touchton is granted. Respondent’s Objection to the Declaration of John Hofmeyer is denied.

7. This matter shall return to Dept. 404 for a review and compliance hearing on September 5, 2019, at 9:00 a.m.
