RESPONDENT’S MOTION TO QUASH SERVICE OF PETITIONER’S PETITION FOR CIVIL HARASSMENT RESTRAINING ORDER TENTATIVE RULING:

Petitioner’s request to present oral testimony at the hearing on this Motion is DENIED. Petitioner has not established good cause to present such testimony pursuant to California Rules of Court rule 3.1306(a).

Respondent’s Motion to Quash Service of Petitioner’s Petition for Civil Harassment Restraining Order is GRANTED pursuant to Code of Civ. Proc. Section 418.10. Respondent’s request to dismiss the action is DENIED.

The hearing on Petitioner’s Petition for Civil Harassment Restraining Order is set for February 18, 2020 at 9:00 a.m. in the Law and Motion Department of this Court. Petitioner must personally serve the Petition and appropriate paperwork on Respondent. The Temporary Restraining Order is continued and extended until the new hearing date.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Petitioner shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
