MOTION FOR JUDGMENT AFTER DEFAULT ON TERMS OF STIPULATION FOR ENTRY OF JUDGMENT BY CAPITAL REALTY GROUP TENTATIVE RULING:

Defendant Hisham Hasan and Brett Barron of Plaintiff Capital Realty Group are ordered to appear personally. Defendant contends that he attempted to make the first two $1,000.00 payments, with cashier’s checks, on July 26, 2019 and August 2, 2019. Defendant is ordered to produce both checks at the hearing.

Defendant shall serve a copy of his Opposition, filed September 3, 2019, on Plaintiff’s counsel if he has not done so already.

Defendant’s Opposition raises significant doubt about whether Defendant failed to make the $1000.00 payments or whether Plaintiff intentionally refused them. If the payments were refused, then the motion is denied. Plaintiff cannot cause Defendant to default and then attempt to obtain entry of judgment based on that default.
