TENTATIVE ORDER

Plaintiff WHA GAK HAN’s unopposed Motion to Compel Defendant’s Further Responses to Form Interrogatories (set one) is GRANTED.

Moving Party to give Notice.

No Opposition filed as of February 4, 2020. The Court notes that at the time this Motion was filed, Defendant CHO was in pro per. Therefore, Motion was served directly onto Defendant CHO on November 8, 2019. On January 17, 2020, a Substitution of Attorney was filed indicating that Defendant CHO is now represented by Attorney Soon O. Kim.

The unopposed Motion to Compel Further is granted. Defendant DUK YON CHO is ORDERED to provide further verified responses to Form Interrogatories (set one) Nos. 15.1 and 17.1 no later than 10 days from the Court’s issuance of this Order. This date may be extended pursuant to agreement of the parties.

Further, the Court finds that the Moving Party has have established an entitlement to monetary sanctions. As indicated above, no Opposition has been filed as of February. Defendant has not acted with substantial justification, and the Court is unaware of other circumstances that would make the imposition of sanctions unjust. Plaintiff’s requests for monetary sanctions are granted in part.

Defendant DUK YON CHO is ORDERED to pay Plaintiff WHA GAK HAN and his counsel of record sanctions in the amount of $760.00 ($350 x 2) ($60 costs) no later than 30 days from the Court’s issuance of this Order. This date may be extended pursuant to agreement of the parties.
