State – change of plea and sentencing – Thunder would plead guilty to counts 1 & 2 as alleged and a with held sentence of 2 years probation, court costs, AODA and follow through, absolute sobriety, no possession of alcohol, no entry into bars or taverns, FT employment/schooling, 100 hours of community service. Joy and Thunder agree. Thunder pleads guilty to both counts as alleged. Court has PLQ and goes over the form with Thunder, finds he is freely, voluntarily and intelligently entering his plea, waiving his constitutional rights and right to trial. Court factual basis exists, accepts pleas of guilty and adjudges guilty of counts 1 & 2 as alleged. State makes final statement, provided copy of criminal history to the court and asks court to follow the joint recommendation. Joy makes final statement and asks court to follow joint recommendation. Thunder with holds comment. Court accepts all statements, will accept joint recommendation and sentences to the following: On counts 1 & 2 – with hold sentence and place on probation for 2 years with conditions of: AODA and follow through with all recommendations, no consumption or possession of alcohol, no entry into any bars or taverns, pursue and obtain GED, 100 hours of community service, must pay $500 towards fines in Michigan to help obtain driver’s license and will waive all court costs in this case. Joy – asked that the matter be put on the calendar today to address the warrant and his non-appearance last time, states the reasons (medical appointment with child), asks Court to quash the warrant and move forth with the case. Joy and Thunder have complaint, waives reading of it, requests PH but will waive time limits. State – bond – asks that the $500.00 cash be reinstated but put his concerns on the record – would like proof that he was actually at a doctor’s appt with his child. Court responds, can put him under oath. State will forego that at this point. Court – not willing to rreinstate the bond – defendant can file an objection to the forfeiture of the bond and prove to Court why he was not in Court. State – bond – asks for an additional $1000.00 cash. Thunder states that he does not have any money to post and makes statement in regards to why he was not here. Joy makes argument for bond, asks Court to reinstate $500.00 cash bond. State responds.
