Defendants’ motion to compel plaintiff Poppy’s attendance at deposition with
documents is effectively UNOPPOSED and is GRANTED as follows.
Plaintiff’s counsel is admonished for failing to properly serve the opposition papers on
opposing counsel in compliance with Code of Civil Procedure §1005(c) but the
opposition was nevertheless considered by the Court.
Plaintiff Poppy shall appear for deposition with the requested documents and submit to
oral examination no later than 1/18/2014, unless moving defendants agree to a later
date. Moving defendants shall promptly make a good faith attempt to coordinate with
plaintiff’s counsel a mutually agreeable date for this deposition.
Monetary sanctions pursuant to Code of Civil Procedure §2025.450(g)(1) are awarded
against plaintiff Poppy and his counsel, jointly and severally, in the amount of $772.30,
representing three hours of attorney time at $165 per hour, the $60 filing fee and the
$217.30 court reporter fees. Sanctions to be paid no later than 1/31/2014. If not paid
by that date, defendants may prepare for the Court’s signature a formal order awarding
sanctions, which may then be enforced as a separate judgment. (Newland v. Superior
Court (1995) 40 Cal.App.4th 608, 615.)
This minute order is effective immediately. No formal order or other notice is required.

opposing counsel in compliance with Code of Civil Procedure §1005(c) but the
opposition was nevertheless considered by the Court.

oral examination no later than 1/18/2014, unless moving defendants agree to a later
date. Moving defendants shall promptly make a good faith attempt to coordinate with
