[TENTATIVE] ORDER GRANTING CROSS-DEFENDANTS’ MOTION TO CONTINUE TRIAL

Cross-Defendant Hasa Inc. seeks an order continuing the trial date.

CRC Rule 3.1332(c) permits the court to grant a continuance of a trial date based upon good cause. Good cause may be shown when a new party is added to the suit and has not had a reasonable opportunity to conduct discovery and prepare for trial, or when the other parties have not had a reasonable opportunity to conduct discovery and prepare for trial in regard to the new party’s involvement in the case. (CRC Rule 3.1332(c)(5)(A)-(B).) The court may consider other factors, including whether all parties have stipulated to the continuance. (CRC Rule 3.1332(d).)

This case is currently set for trial on 4/26/17. Cross-Defendant Hasa Inc. entered into this case on 1/5/18. Cross-Defendant has not yet analyzed the claim, nor conducted any investigation or discovery, nor retained any experts in its behalf. No depositions have taken place and Plaintiff’s independent medical examination has not taken place.

To date, no party has filed opposition to the motion. Furthermore, on 1/8/18, the parties filed a stipulation to continue the trial to 10/29/18.

The Court finds that Cross-Defendant has demonstrated good cause for a continuance of the trial date. The 1/8/18 stipulation indicates that a continuance would not prejudice any party. Cross-Defendant Hasa Inc.’s motion to continue trial is GRANTED.

The trial date of 4/26/18 is advanced to today’s date and continued to 10/30/18 at 8:30 a.m. in Department 92. The FSC date of 4/10/18 is advanced to today’s date and continued to 10/16/18 at 10:00 a.m. in Department 92. All discovery and discovery motion cut-off dates are continued to reflect the new trial date.

Cross-Defendant is ordered to provide notice of this ruling.
