BRENDTJOHN MIJOS OCHAVILLO AND HELEN OCHAVHLO’S MOTION TO COMPEL PLAINTIFF HUSSAM ELNORY TO SUBMIT FOR PHYSICAL EXAMNINATION AND REQUEST FOR SANCTIONS TENTATIVE RULING:

Defendants’ motion to compel Plaintiff’s physical examination is GRANTED. Defendant’s request for sanctions is GRANTED. Plaintiff is ordered to pay Defendant $550 in sanctions within 14 days of service of written notice of this order.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Defendants shall prepare a written order consistent with the Court’s ruling for the Court’s signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.

Defendants’ motion to compel Plaintiff’s deposition is GRANTED. Defendant’s request for sanctions is GRANTED, in part. Plaintiff is ordered to pay Defendant $972.50 in sanctions within 14 days of service of written notice of this order.
