Defendant, Plaza Del Valle, LLC’s Motions to Compel Defendant Jeronimo Zaca’s responses to set one Form Interrogatories, Request to Identify and Produce Documents; and for sanctions is granted. Defendant Jeronimo Zaca to respond without objection within 20 days. Sanctions of $645.00 are imposed against Defendant Jeronimo Zaca and counsel.
Plaintiff, Isabel Negrete filed this action against Defendants, Jeronimo Zaca dba Iztaccihuatl Vintage and Plaza del Valle for damages arising out of an alleged trip and fall over a metal rail of the security gate.
Defendant/Cross-Complainant Plaza Del Valle, LLC (hereafter referred to as “moving party”) propounded set one of Form Interrogatories and Request to Identify and Produce Documents and Material for Inspection and Copying to Defendant/Cross-Defendant Jeronimo Zaca (“Zaca”) on 7/17/13. Responses were due no later than 8/21/13. CCP §§ 2030.260(a), 2031.260(a). On 8/27/13, moving party counsel sent Zaca a letter requesting responses. Exhibit 2. To date, Zaca has failed to respond or provide responses.
In addition, Zaca does not oppose this motion. Therefore, the responses should be compelled.
Moving party seeks sanctions of $645.00 (total for both motions) against Zaca and counsel for the time spent preparing this motion and attending the hearing. The Court finds that sanctions are appropriate based on Defendant Jeronimo Zaca’s willful failure to abide with discovery obligations. CCP §§ 2030.290(c), 2031.300(c). The request for sanctions is therefore granted.
